The consultation on the reference price methodology for the Transit Gas Pipeline for years 2023-2024

In accordance with the decision of the President of the Energy Regulatory Office DRG.DRG-2.7129.5.2018.JDo1 dated 16 July 2018, GAZ-SYSTEM has been appointed as the entity responsible for carrying out periodic consultations pursuant to Article 26 of the TAR NC, under which this document detailing the proposed reference price methodology is published.

Any comments to the reference prices methodology should be sent on the e-mail address: nctar_sgt@gaz-system.pl by 31 October 2021. In order to ensure transparency and efficiency of the consultation process, the Company kindly requests to send comments also in English.

In response to the periodic consultation on the proposed reference price methodology for the Transit Gas Pipeline for years 2023-2024 conducted by GAZ-SYSTEM, in fulfilment of Article 26 of the TAR NC, the following entities replied:

  • European Federation of Energy Traders (EFET),
  • PGNiG SA.


The responses received referred to the following aspects of the proposed reference price methodology:

  • Discount for Mallnow Entry point,
  • The length of the regulatory period in refer to Entry Exit split and stability on tariff rates,
  • The level of forecasted capacities being base for the indicative tariff rates calculation,
  • The different RPM proposed and possibility of merging the TGPS and National Transmission System.

The consultation on the reference price methodology for the Transit Gas Pipeline for years 2020-2022

On 28th August 2018 Gas Transmission Operator GAZ-SYSTEM S.A. (hereinafter: GAZ-SYSTEM), performing the duties of the operator on the transmission network owned by EUROPOL GAZ S.A. started the process of consulting and approving the methodology of setting the reference prices for gas transmission services. The consultation aims to enable the network users to better understand the principles of transmission services tariffs  calculation and changes introduced in these tariffs and the manner they are set.

This obligation was imposed on GAZ-SYSTEM by the decision of the President of the Energy Regulatory Office of July 16, 2018, issued in accordance with the provisions of Commission Regulation (EU) 2017/460 of March 16, 2017 establishing a network code on harmonized transmission tariff structures for gas.

Commission Regulation (EU) 2017/460 of 16 March 2017 establishing a network code on harmonised transmission tariff structures for gas contains rules concerning the application of the reference price methodology and calculation of reserve prices for standard capacity products. The union-wide rules having the objectives of contributing to market integration and enhancing the security of supply and promoting the interconnection between gas networks shall be fully implemented in the Member States by 31 May 2019.

The aim of the TAR NC is the harmonisation of the Member States transmission operators tariff structures and designating a set of instruments enabling the comparison of the transmission tariffs used across EU countries (such as CAA described in article 5 and CWD described in article 8). The code allows TSO to choose individually the reference price methodology calculation, taking into account the gas market development level and the network complexity.

In accordance with the provisions of the TAR NC and pursuant to the decision of the President of the National Regulatory Office (hereinafter: URE) of 16 July 2018 GAZ-SYSTEM has been designated as the entity responsible for conducting periodic consultations for the transmission network owned by EUROPOL GAZ S.A. on which the Company acts as the operator of the gas transmission system. As part of the consultation process, a document describing the proposed method of tariff calculation is published. The consultation and approval process for the chosen methodology for determining the reference price and the tariff calculation for 2020 consists of the following stages:

Final consultation – minimum duration – 2 months

28 August – 31 October 2018

Publication of the responses received in the consultation process –  within one month following the end of the final consultation

till 30 November 2018

The evaluation and analysis of the consultation document by ACER – within 2 months following the end of the final consultation

till 31 December 2018

The approval and publication of the motivated decision of the President of URE  - within 5 months following the end of the final consultation

till 31 March 2019

Recalculating the tariff based on the approved reference price methodology, decision of the President of URE approving the tariff for 2020.

1 April – 31 May 2019 

In the consultation procedure commencing on 28th of August with the publication of this consultation document and lasting until 31st of  October 2018 the relevant stakeholder may send consultation responses to the following mailbox nctar@gaz-system.pl (abbreviation SGT should be added to the title of e-mail).

According to the article 26 (2) of the TAR NC the deadline for submitting the responses concerning the proposed reference price methodology is the end date of the final consultation – 31st October 2018.

Pursuant to the provisions of the TAR NC replies submitted in response to the consultation shall include a non-confidential version suitable for publication within the following stage of the procedure.

Within the consultation process concerning the proposed reference price methodology for the transmission network owned by EUROPOL GAZ S.A. GAZ-SYSTEM did not receive any answers for the market participants.
